These Terms of Service ("Terms") govern your use of the websites smartdriver.ai and its subdomains (including l.smartdriver.ai) (the "Services"), operated by Outfight LLC, a Wyoming limited liability company, doing business as "Smart Driver" ("we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Nature of Our Services

Smart Driver is a marketing and lead referral service. We are not an insurance company, agency, or broker. We do not sell, solicit, negotiate, or bind insurance policies and we do not provide insurance advice. When you submit a quote request, we refer your information to licensed third-party insurance marketing partners and marketplaces, who will contact you with quote options.

2. No Affiliation with Insurers or Government

Smart Driver and Outfight LLC are not affiliated with, endorsed by, or sponsored by any insurance carrier or any federal, state, or local government agency.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Services.

4. Your Consent to Be Contacted

By submitting a quote request and checking the consent box on our form, you provide prior express written consent to be contacted by Outfight LLC, our marketing partners, and their participating licensed insurance providers by telephone (including via automatic telephone dialing system or artificial or prerecorded voice), text message (SMS/MMS), and email, at the contact information you provide, even if that number is on a Do Not Call list. Consent is not a condition of any purchase or of receiving a quote. Message and data rates may apply. You may revoke your consent and opt out at any time as described in our Privacy Policy and Contact page.

5. Accuracy of Information

You agree to provide accurate, current, and complete information when you request a quote, and that the telephone number and email address you provide belong to you. You are responsible for any inaccurate or misleading information you submit.

6. No Insurance Advice; No Guarantees

Information provided on the Services is for general informational purposes only and is not insurance, legal, tax, or financial advice. We do not guarantee that any partner will contact you, that you will be offered a quote, that any quote will be the lowest available, or that you will qualify for any particular coverage. Rates, coverage, and availability are determined by licensed third-party carriers and agents in their sole discretion.

7. Intellectual Property

All content on the Services, including text, logos, graphics, and code, is owned by Outfight LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Prohibited Conduct

You agree not to:

• Submit false, misleading, or third-party information without authorization.
• Interfere with the operation of the Services, including through automated scraping, bots, or denial-of-service activity.
• Attempt to gain unauthorized access to any portion of the Services.
• Use the Services in violation of any applicable law or regulation.

9. Third-Party Services

The Services may contain links to, or refer your information to, third parties, including our marketing partners. We are not responsible for the content, privacy practices, or conduct of any third party. Your interactions with third parties are solely between you and them.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTFIGHT LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold harmless Outfight LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Services or your breach of these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time by posting the updated Terms on the Services with a new "Last updated" date. Your continued use of the Services after any update constitutes acceptance of the revised Terms.
